This Scratch and Smoke promotion is run by Flower Company aka Endors Toi PBC (“Flower Co.”, “Flower Company”, or “Sponsor”).
This Promotion is free of charge and is subject to these Official Rules (these “Official Rules”) and to all applicable federal, state, and local laws and regulations in the United States. Open only to legal California residents who are 21 years of age or older at the time of entry.
By entering and participating in this Promotion, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below.
1. How to Enter
No purchase is necessary, and purchases will not increase your odds of winning. Beginning in
December 2021, and running until such time as the supply of game cards expires, you can request
one game card a week by visiting

and submitting the form with your name, address, email address, age, and phone number. By
requesting a ticket, you assert that you are eligible to participate, per the eligibility
requirements established below. After completing and submitting the online entry form on the
Website for this Promotion during the Promotion Period, you will be sent a game card, with equal
odds to all other cards of winning all prizes. Incorrect and incomplete entries are void.
Additionally, Flower Company customers will also receive a game card with each order completed with Flower Company during this time.
2. Eligibility
Sweepstakes participation is open only to legal residents of California who are 21 years of age
or older at the time of entry. No purchase of any kind necessary to enter or win. A purchase
does not increase your chances of winning. Void where prohibited or restricted by law. The
Sweepstakes is being conducted as a consumer sweepstakes. All federal, state and local laws and
regulations apply.
The following individuals are not eligible to participate or win: employees, contractors,
directors and officers of Sponsor and each of its respective parent, subsidiaries and affiliated
companies, or any direct relatives of such individuals. For the purposes of this Promotion,
“employees” shall include all individuals who have entered into an employee, independent
contractor and/or consultant agreement with the Sponsor or any of its affiliates.
3. Privacy
In connection with this Promotion entry process, Sponsor will be collecting personal data about
entrants on the Website, in accordance with its Privacy Policy. Please review Sponsor’s Privacy
Policy located at http://flowercompany.com/privacy. By participating in the Promotion, you
hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that
you have read and accepted Sponsor’s Privacy Policy.
Except as prohibited by law, the winner’s entry and acceptance of the Prize constitutes permission for the Sponsor to use said winner’s name, photographs, videos, likeness, statements, biographical information, voice, and city and state addresses on a worldwide basis, and in all forms of media now known or hereinafter known, in perpetuity, without further compensation.
In accordance with the California Consumer Protection Act, the Sponsor has a process in place that will allow consumers to obtain and delete all of the personal information gathered for the purposes of this promotion. To request that any personal information collected during, or in association with, this promotion be removed from our systems, please mail a request to that effect to 5560 West End Rd, Suite 3/ Arcata, CA 95521 to the attention of “Scratch and Smoke Privacy,” including your name, email address, phone number, and confirmation of your age, and sign that request.
4. Prizes and Odds of Winning
No alternative prizes or other substitutions are permitted. Prizes are nontransferable/
non-saleable. All federal, state and/or local taxes are the sole responsibility of the winner.
Sponsor will provide 1099 tax forms to any winner with a prize valued over $600. There are
15,174 cards in existence. The promotion will begin in December 2021, and cease upon
distribution of all cards. All prizes must be claimed through standard, non-express, orders.
Grand Prize: The Grand Prize is a trip to Humboldt County and Flower Co.’s HQ. Includes 2 roundtrip air tickets from anywhere in California, 2 nights in a hotel in Humboldt, stipends for food and transportation, and a tour of the Flower Co. production facility and headquarters. Estimated retail value $2,000, and the odds of winning are 1 in 15,174.

5. Winner Notification
Winners of all prizes shall reveal the prize upon scratching his/her card. Each card wins one of
the prizes above. The card will indicate how to claim each prize. For Top and Grand Prize
winners, a phone number is provided on the card, to receive further instructions on how to claim
the prize, and to confirm the winners’ identity, eligibility, shipping address, and any other
needed information. Winners may be required to sign, have notarized and return an Affidavit of
eligibility and liability/publicity release (except where prohibited) within five (5) business
days of receipt of such document(s) and to fulfill any such other requirements as determined by
Flower Co. in order to claim his/her prize. If the potential winner fails to provide such
Affidavit or release or fulfill such other requirements within the required timeframe, he/she
may be disqualified and forfeit the applicable Prize. Winners will have until December 1, 2022 to
claim all prizes.
6. Conduct
By entering this Promotion, entrants agree to be bound by these Official Rules and the decisions
of the Sponsor (which shall be final and binding in all respects). These Official Rules are
accessible from the Website throughout the Promotion Period. Failure to comply with these
Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion
to disqualify any individual suspected of (i) tampering with the entry process or the operation
of the Promotion or the Website; (ii) to be acting in any manner deemed by Sponsor to be in
violation of the Official Rules; or (iii) to be acting in any manner deemed by Sponsor to be
unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other
person.
7. Limits and Liabilities
By participating in the Sweepstakes, each participant agrees to release and hold Sponsor and the
employees, officers, directors, shareholders, agents, representatives of Sponsor, its parent
company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal
advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in
connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize,
including without limitation, personal injury, death, and property damage, and claims based on
publicity rights, defamation, or invasion of privacy.
Sponsor, those working on its behalf, and all other businesses involved in this Promotion (including any Prize vendor/provider) (collectively with Sponsor, the “Promotion Entities”); their respective affiliates, subsidiaries, parent, advertising and promotion agencies; the foregoing persons’ officers, directors, shareholders, employees and agents; and any and all Internet servers and access provider(s) are not responsible for: (i) any incorrect or inaccurate entry information; (ii) printing or human or other errors; (iii) technical malfunctions; (iv) failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other person’s computer relating to or resulting from participation in this Promotion; (v) inability to access the Website; (vi) theft, tampering, destruction, or unauthorized access to, or alteration of entries; (vii) transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; and (viii) any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof.
If this Promotion is not capable of running as planned, including, because of any infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or other cause beyond Sponsor's control which corrupts or threatens to corrupt or adversely affects the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, in its sole discretion, to cancel, suspend and/or modify this Promotion and Sponsor may, in its sole and absolute discretion, perform the random drawing from among all eligible entries received prior to such cancellation, suspension or modification of the Promotion.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
8. Winners List
To request a copy of the top and grand prize winners list, which will be made available at least
thirty (30) days after the end of the claiming period (December 1, 2022), please send a
